Section 75.10 - Definitions

Proper Installation and Service

(22) Proper installation, and service

    (A) Applicable municipal ordinances and codes adopted by a municipality where the installation
    occurs
    (B) The current Uniform Mechanical Code or the current International Mechanical Code and
    International Fuel Gas Code, in areas where no code has been adopted;
    (C) The manufacturers specifications and instructions; and
    (D) All requirements for safety and the proper performance of the function for which the equipment
    or product was designed.


With respect to item (A)
It is in the contractors best interest to know what set of codes are in effect along with any amendments that
have been  adopted to those codes
prior to accomplishing ANY work. This knowledge can prevent
problems with TDLR and/or the municipality that you are working in. Additionally it should be understood
that the structure owner
DOES have legal recourse should the installation/repair NOT be in compliance
with these code/amendments

With respect to item (B)
Installations/repairs that are being accomplished outside of the jurisdiction of a given municipality MUST
still comply with the codes listed in this section. The same legal ramifications that apply to (A) also apply to
(B)

With respect to item (C)
Manufactures installation instructions are considered PART OF THE CODE. If the installation IS NOT in
accordance with those instructions, TDLR/Local Municipality and the structure owner will have legal
recourse.

With respect to item (D)
If the installation or repair is accomplished in manner that is unsafe and/or if the equipment as a result of
improper installation will not preform properly as defined by the manufacturer TDLR/Local Municipality and
the structure owner will have legal recourse.
